City Files to Prevent Prisoner Release by County
To forestall any future releases of prisoners from the County Jail based on budget concerns, the City of Fresno today (Monday) filed suit in Fresno County Superior Court against Sheriff Margaret Mims and the County of Fresno.
According to City Attorney James C. Sanchez, the suit seeks a court order specifying state judicial processes to be followed prior to any budget-related inmate releases. In addition, in the event of any releases the Sheriff would be directed to provide prior notice to the City’s Chief of Police, and any victim of the released inmate, regarding name of prisoner, list of offenses, and date of scheduled release.
“The public safety threat presented by illegal prisoner releases by the Fresno County Sheriff has forced the City to file a lawsuit,” noted Mr. Sanchez. “The suit seeks a court order specifying state judicial process to be followed prior to any budget-related prisoner releases. And the process would provide the City an opportunity to be heard by the Court prior to any release.”
