Annexations
The Cortese-Knox-Hertzberg Local Government reorganization Act of 2000 (Act) establishes procedures for local government changes of organization, including annexations to a city or special district, city incorporations and city and special district consolidations. Local agency formation commissions (LAFCOs) have numerous powers under the Act, but those of primary concern are the power to act on local agency boundary changes and to adopt spheres of influence for local agencies. Among the purposes of LAFCOs are the discouragement of urban sprawl and the encouragement of the orderly formation and development of local agencies.
In an attempt for orderly formation and development for the benefit of both City and County residents and to provide adequate and timely services (i.e., police, fire, sewer and water, etc.), the City and County of Fresno have a Memorandum of Understanding (MOU) which stipulates which properties are annexed into the City and the timing of such annexations. Note that as part of the MOU, all annexations must be considered by the County of Fresno LAFCO. To further improve services and to minimize the impacts on newly annexed properties, the City recently adopted the "ANX" Transitional Overlay District for maintaining the rural lifestyle for properties that are not part of a larger development.
